The boy and the gun owner will not be prosecuted in this case.

An 11-year-old boy was fatally shot Tuesday night by his younger brother, after the family unexpectedly stopped to see relatives in Allentown, the Lehigh County district attorney announced Wednesday.

District Attorney Jim Martin said the victim’s 10-year-old brother accidentally shot him with a gun owned by a relative who lived at the home in the 600 block of North Front Street in the city.

Martin said the 10-year-old boy and the relative, a 24-year-old man that lives in the home, will not be prosecuted; no one has been identified by authorities.

The night of the shooting, the boys and their parents unexpectedly stopped at the relative’s home on Front Street.

The relative legally owns two 9mm guns and had them in the home’s basement, Martin said. The firearms were out of a lock box because the owner recently went shooting and was planning to clean them, the district attorney said.
